The terms and conditions of use and privacy policy (collectively, the “Terms of Use”) listed here apply to any application or content located on the domain space https://agnes.queensu.ca or https://www.agnes.queensu.ca (“Site” or “the Site”) of Agnes Etherington Art Centre made by you, as well as to any agreements concluded between you Agnes Etherington Art Centre.
If you do not agree to these Terms of Use, you should not buy any products or services (“Items”) through the Site. We may make changes to the Site, these Terms of Use, or the policies and conditions that govern the use of the Site at any time. We encourage you to review the Site and these Terms of Use periodically for any changes. Your continued use of the Site signifies your acceptance of these changes.
Agnes Etherington Art Centre will not permit any conduct by you that, in our sole discretion, restricts or inhibits any other user from using or enjoying the Site. We may terminate your access, or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party or us.

Personal Information is collected in accordance with Ontario’s Freedom of Information and Protection of Privacy Act and other applicable legislation, including the European Union’s General Data Protection Regulation (GDPR) and is used for the purpose of University activities. You will receive an e-mail confirmation of your order of Items and we will ship it using Canada Post, UPS FedEx or Purolator.
Agnes Etherington Art Centre accepts the following forms of payment for the online store: VISA and MasterCard. All prices are in Canadian Dollars.
If you are not satisfied with Items you purchased on the Site, you may obtain a full refund if the item is retuned in good condition within 60 days of purchase.
Registration fees for courses, workshops and camp programs are subject to the Cancellation Policy:
Cancellation notification must be received via email to aeacpa@queensu.ca. In the event of cancellation of registration, we charge a non-refundable $75.00 processing fee. Less than 14 days prior to start of the course or camp: 50% of fee. Less than 48 hours prior to start of the course or camp: no refund.
We reserve the right to cancel a class or camp if there is insufficient registration or due to forces beyond its control. In such cases, we will offer a full refund, or the option to apply the fee to another program, at the discretion of the registrant.
We may elect to electronically monitor areas of the Site and may disclose any content, records, or electronic communication of any kind:
We are not responsible for screening, policing, editing, or monitoring such content. If notified of allegedly infringing, defamatory, damaging, illegal, or offensive content, we may investigate the allegation and determine in our sole discretion whether to remove or request the removal of such content from the Site.
By ordering Items from this Site, you understand and agree that you are entering into a contract directly with Agnes Etherington Art Centre in Kingston, Ontario, Canada (“Kingston”) and that your order is being accepted by Agnes Etherington Art Centre in Kingston. You further understand and agree that in all circumstances relating to or arising from the use of the Site and/or from any agreement between you, Canadian law shall govern the agreement. Any disputes relating to or arising from the use of the Site and/or from any agreement between you and us must be submitted to a competent court in Ontario. All images and text (“materials”) posted on the Art Centre’s website are thereby protected by copyright. The user may not distribute, modify, transmit, reuse, download, copy, or use the materials on this site for public or commercial purposes, or for personal gain, without the express written permission of the Art Centre. Any unauthorized use of these materials may violate copyright laws, trademark laws, the laws of privacy and publicity, contract, and communications regulations and statutes and any other applicable laws. Agnes Etherington Art Centre may provide access to its digital, photographic and textual materials. Access to any materials held by Agnes Etherington Art Centre should be obtained from this institution so that correct captions, credit lines, and other restrictions may be observed. Please fill out the request form. All reproductions of images are made to order and clients will be invoiced accordingly. Photographic reproduction costs are charged in accordance with the current price schedule, which is subject to change without notice. Usage fees may also apply.

You will assist and co-operate as fully as reasonably required by the Indemnified Parties in the defense of any such claim or demand.
